Area of application

These general conditions of sale are concluded between, on the one hand, the client : « or user» or« you», the visitor who wishes to make a purchase on the site http://www.cachemire-du-nepal.com, and on the other hand, the company Bruno Grégoire, registered at the Narbonne Chamber of Commerce: reg. n° 491 849 907

The client acknowledges acceptance, of the Conditions of Sale. Les present conditions of sale refer to the contractual relations between the business, Bruno Grégoire, and the client, the two parties accept them without reserve.

Orders

The automatic system of registering orders is considered as proof of the order, its nature, the contents and the date of the order. The company, Bruno Grégoire, confirms the acceptance of the order to the client at the email address that he has given.

The company, Bruno Grégoire, reserves the right to cancel any order from a client with whom there is an existing litigious case relative to a previous order.

The information supplied by the purchaser, at the time of passing the order are his/her responsibility. In case of error in the delivery address, the entreprise will not be held responsible in case of the impossibility to deliver the product.

Delivery

The products ordered on this web site will be sent to the address that you have given us when ordering. The delivery time of 10 working days mentioned on the site is an indication but may be modified.

The company, Bruno Grégoire, cannot be held responsible for the consequences due to a delay in delivery or loss of the package by the transporter. In case of non-reception of a package in the time indicated, and enquiry will be made to the transporter which could take several days. During this period, no refund or sending a replacement can be made.

When you receive your package, you should verify that it conforms with your order and if there is any anomoly you should indicate it in writing on the delivery form, accompanied by your signature.

You should also confirm to the company, Bruno Grégoire, by letter or email (info@cachemire-du-nepal.com), these reservations the same day or at the latest one working day after receiving the delivery. Any claim after this time cannot be accepted and releases the company from all responsibility.

Cost of delivery within France : 5,00 €
Outside France : 13,00 €

Price

The price is expressed in euros. The price indicated in the order confirmation is the fixed price, all taxes included including VAT for france and the countries of the EEC. This price includes the cost of the product, the cost of handling, packing and conservation of the products.

The price indicated on the product details page does not include the cost of delivery. This cost is charged to the buyer and invoiced at the end of the order as a supplement to the products chosen.

We reserve the right to modify our prices at any time but we guarantee to apply the prices previously indicated on the site at the time of placing the order.

Method of payment

By credit card.
payment should be made by crdit card, Visa, American Express or Mastercard.
The price invoiced to the client is the price indicated on the confirmation of the order sent by the company. The price of the articles is payable the day of placing the order.

Right of retraction

Conforming to the dispositions of article L 121-20 of the Code of Consommation, you have a seven clear day limit from the time of delivery of their order, to return the items for exchange or refund, without penalty, less return expenses.

You can during this time return the product, at your expense, accompagnied by the invoice. We recommend that you return the goods by registered post and take out an insurance with the transporter for the value of the goods. This in case of loss or damage of the goods by their service. In any case, the return of the goods is at the risk of the buyer. Only goods complete with any accessories and in new condition returned in their original packaging will be accepted for refund.


Product

The photographs showing the products are not contractually binding. If there is any error, in no case can the company be held responsible. The articles visible on the site will be available until the stock is exhausted.

In case of payment for an article that is no longer available, the company promises to reimbourse, within 15 days, the amount paid for a payment by Credit Card via PayPal. In all cases the company promises to inform by email any client who has ordered an article that is not available.

Litigation

This contrat is subject to French legislation. The company cannot be held responsible for any damage of whatever nature, either material, immaterial or corporel, that results from a misfunctionning or misuse of our products.

The responsibility of the company will in any case be limited to the amount of the order and will not be attacked for simple mistakes or omissions that might happen in spite of all precautions taken in the presentation of the products. In case of problems in the application of this contract, the buyer has the possibilty, before taking any legal action, to look for an amicable settlement notably with the help of a professional association, or a cosumers association or any other coucellor of their choice. It is reminded that the search for a amicable solution does not interrupt the "brief period" of the legal guarantee, neither the legnth of the contractual guarantee. It is reminded that as a general rule and subject to the assessment of the tribunals, the respect of the clauses of this contract relating to the contractual guarantee suppose that the buyer honours his financial obligations towards the seller.

Any claims or contestations will always be politely received, the good faith of the client is always presumed from any client that takes the trouble to make a complaint.

In case of litigation the client should first contact the company to try to obtain an amicable settlement. Failing this the Narbonne Tribunal of Commerce is the competant body, whatever the delivery addrss or method of payment.
